These terms govern your use of drainflix.com and any purchase you make from it. The site is operated by Drainflix from 2660 NE 192nd Terrace #713, Miami, FL 33180. By browsing the site or placing an order you agree to what’s set out below. If you don’t agree with something here, please don’t use the site.
Using the site
You may browse, and buy for your own use. You may not scrape the site, copy its contents for republication, interfere with its operation, or attempt to gain access to areas you’re not authorised to reach. To place an order you need to be at least 18, or have a parent or guardian do it for you.
Photography and copyright
This is the part worth reading twice. Every photograph, video, design and piece of written content on this site is the property of Drainflix and is protected by copyright. Nothing on this site is stock imagery and none of it is free to use.
Buying a print does not transfer copyright. When you buy a fine art print you’re buying a physical object to own and display. You do not acquire the right to:
- reproduce, scan, photograph or digitise the image;
- resell reproductions of it, or produce derivative works from it;
- use it commercially — in advertising, merchandise, packaging, on a website, or to promote a business;
- use it to train machine learning or generative AI systems.
Personal display in your home or workplace, and non-commercial social posts showing the print in situ, are welcome and appreciated. If you want to license an image for commercial use, that’s a conversation we’re happy to have — email info@drainflix.com.
Apparel designs and logos are likewise ours. Buying a shirt doesn’t grant any right to reproduce the artwork on it.
Products, descriptions and colour
We describe our products as accurately as we can, but screens vary. Colour, tone and contrast in a print or garment may differ slightly from what you see on your monitor or phone, and prints are photographic works with the grain, depth and character of the original image. Small variations between individual made-to-order items are part of the process, not a defect.
Sizes are given as guides. Check the size information on the product page before ordering.
Prices and payment
All prices are in US dollars and exclude shipping unless stated. We can change prices at any time, but a change never affects an order already placed. Payment is taken at checkout through WooPayments, powered by Stripe.
Very occasionally a product may be listed at the wrong price or with the wrong description because of a genuine error. Where that happens we’re entitled to cancel the order and refund you in full, even if it has already been confirmed. We’ll always contact you first.
Orders
Your order is an offer to buy. Our confirmation email acknowledges we’ve received it, but a contract only forms when we dispatch the item. We may decline or cancel an order — for example if an item is out of stock, if we can’t take payment, if we can’t ship to your address, or where we suspect fraud. If we cancel, you get a full refund.
Shipping, returns and refunds
Delivery is covered in our Shipping Policy, and returns, replacements and refunds in our Returns & Refunds policy. Both form part of these terms.
Commissioned work and services
Creative direction, production, consulting and event coverage are not sold through this site. Enquiries made through the contact form are just that — enquiries. Any such work is governed by a separate written agreement covering scope, fees, usage rights and delivery, not by these terms.
What you send us
If you send us a message, image or other material through the site, you confirm it’s yours to send and that it isn’t unlawful or infringing. We may use what you send to respond to you and to keep a record of the exchange. How we handle personal information is set out in our Privacy Policy.
Availability of the site
We try to keep the site up and working, but we don’t guarantee it will always be available or error free. We may change, suspend or withdraw any part of it, including products, at any time.
Liability
We stand behind what we sell: if an item is faulty, damaged or not as described, we’ll replace or refund it as set out in our returns policy. Beyond that, and to the fullest extent permitted by law, Drainflix is not liable for indirect or consequential losses — lost profits, lost data, or losses that weren’t reasonably foreseeable. Nothing in these terms limits liability for fraud, or for anything else that can’t lawfully be limited.
Governing law
These terms are governed by the laws of the State of Florida, United States. Any dispute will be handled by the courts of Miami-Dade County, Florida.
Changes
We may update these terms. The version in force is the one published here on the date of your order, and the date at the top of this page shows when it last changed.
